1. Acceptance of Terms
By accessing or using Navlytics ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including merchants who have created an account.
2. Description of Service
Navlytics is a navbar analytics SaaS platform that enables merchants to track navigation click behavior on their websites. The Service collects nav click events, session data, and device information to provide analytics dashboards, revenue attribution, and funnel reporting.
3. Fair Use
Each plan includes a monthly event limit subject to fair use:
• Starter: up to 50,000 events/month
• Growth: up to 500,000 events/month
• Agency: up to 5,000,000 events/month
Navlytics reserves the right to contact merchants who consistently exceed their plan limits and may require an upgrade to a higher-tier plan. We will always provide reasonable notice before taking any action.
4. Pricing and Changes
Navlytics reserves the right to change pricing at any time. Existing customers will receive at least 30 days written notice before any price change takes effect. Continued use of the Service after the notice period constitutes acceptance of the new pricing.
5. "Unlimited" and Fair Use
Any reference to "unlimited" in plan descriptions or marketing materials is subject to our fair use policy as described in Section 3. Navlytics does not guarantee unlimited capacity and reserves the right to apply reasonable usage limits to ensure service quality for all customers.
6. Cancellation
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months or unused time remaining in a billing period.
7. Limitation of Liability
The Service is provided "as is" without warranty of any kind. Navlytics does not guarantee uptime, availability, or fitness for a particular purpose. To the maximum extent permitted by applicable law, Navlytics shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Service.
8. Data
Navlytics collects navigation click data, session identifiers, page URLs, and device type on behalf of merchants. This data is used solely to provide the analytics service. Navlytics will never sell, rent, or share merchant data with third parties for advertising or commercial purposes.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
